Fifth Circuit Addresses Bond Hearings for Prolonged Immigration Detention: What Immigrants Should Know

Being detained by immigration authorities can be frightening for both the person in custody and their family. When detention continues for months without a meaningful opportunity to challenge it, serious due process concerns can arise.

A recent Fifth Circuit decision addressing prolonged immigration detention provides an important development for certain detained immigrants seeking an opportunity for a bond hearing.

What Did the Court Decide?

The Fifth Circuit considered when prolonged immigration detention may require additional procedural protections.

The court’s decision recognizes that certain immigrants facing extended detention may be entitled to a hearing addressing whether continued detention is justified.

This is particularly significant in the Fifth Circuit, which includes Texas, Louisiana, and Mississippi.

However, the ruling should not be interpreted to mean that every person detained by ICE automatically qualifies for release or a bond hearing.
